JC Master Updates | Attorney Wang Yuehua of our office was invited to deliver a briefing on the Implementing Regulations of the Consumer Protection Law for China Mobile (Suzhou) Software Technology Co., Ltd., thereby supporting consumer rights protection.


On March 12, 2025, Attorney Wang Yuehua, a partner at our office, was invited by China Mobile (Suzhou) Software Technology Co., Ltd. to deliver a specialized lecture on the interpretation of the Regulations for the Implementation of the Consumer Rights and Interests Protection Law of the People’s Republic of China.
 


 

In this lecture, Attorney Wang Yuehua provided an in-depth analysis of the key provisions of the Regulations for the Implementation of the Consumer Rights Protection Law of the People’s Republic of China, focusing on the regulatory framework’s background, the detailed stipulations that clarify consumer rights and supplement operator obligations, and the explicit requirement that operators bear liability for safety guarantees and warranty against defects even for goods and services provided free of charge. The regulations also comprehensively regulate online consumption by prohibiting practices such as “brushing orders and hyping credibility” and “big data price discrimination,” while standardizing mechanisms like “automatic renewals” and “no‑reason returns.” Furthermore, they strengthen the obligations of prepaid‑consumption providers by mandating written contracts to safeguard consumers’ prepaid funds, and they enhance protections for the elderly and minors by banning the inducement of older adults to purchase unsuitable products and by regulating online gaming services to protect the physical and mental well‑being of minors.
 
 

Meanwhile, Attorney Wang also provided a detailed explanation of the scope of application of the “three guarantees” liability and the legal responsibilities associated with products covered by the three‑guarantee policy—issues that are of particular concern to consumers.
 


 

During the presentation, Attorney Wang drew on real‑world cases to make legal concepts more accessible and easier to understand. Using the example of the service contract dispute between Feng* and the Nanjing Branch of Apple Trading (Shanghai) Co., Ltd., he provided a detailed analysis of how the “three‑guarantee” obligations are applied in practice. In another case—Jin v. a certain company over a repair contract—he examined the key points of contention and the court’s ruling, helping attendees grasp how to determine liability and allocate costs under the three‑guarantee regime during the repair process.
 

 

At the conclusion of the lecture, the company’s legal experts addressed questions from employees regarding the legal issues surrounding the company’s cloud computing products.
